Order XIV Rule 5 of the Code of Civil Procedure, 1908, empowers the Court to amend issues or frame additional issues at any time before passing a decree, on such terms as it thinks fit, to resolve all matters in controversy between the parties. Rule 5(2) further allows the Court to strike out any issues that appear to be wrongly framed or introduced. Order XIV broadly deals with Settlement of Issues and Determination of Suit on Issues of Law or on Issues agreed upon.
